Law No. 6570 Regarding Leases of Real Estate

DEPOSIT AMOUNT

According to Article 342 of the Turkish Code of Obligations (Law No. 6098), the deposit payment may be determined provided that it does not exceed the total amount of three months’ rent.

EVICTION UNDERTAKING

According to Article 352, paragraph 1 of the Turkish Code of Obligations (TBK), if the tenant has provided a written undertaking to vacate the leased property on a specific date, the landlord may initiate eviction proceedings based on that commitment.

RENT DETERMINATION LAWSUIT

According to Article 344, paragraph 3 of the Turkish Code of Obligations (TBK), regardless of whether the parties have reached an agreement on the rental price, in lease contracts that exceed five years or are renewed after five years, and at the end of every subsequent five-year period, the rental price may be determined by the judge.
